OPĆE ODREDBE

1. Ovi Opći uvjeti poslovanja (u daljnjem tekstu; OrlandoFit Pravilnik) uređuju odnose između OrlandoFit-a, Ugovaratelja i Korisnika, pravila korištenja usluga OrlandoFit-a i sastavni su dio svakog Ugovora o članstvu.

2. OrlandoFit je trgovačko društvo H.O.L.S. d.o.o., OIB: 23971298808, registrirano kod Trgovačkog suda u Zagrebu, za djelatnosti poboljšanja fizičke kondicije, ostale sportske djelatnosti i drugo. OrlandoFit ima fitness centre u Zagrebu, na lokaciji Nova Ves 17 (Fitness Kaptol) i Radnička cesta 52 (Green Gold Gym).

3. Ugovaratelj je osoba koja sklapa Ugovor o članstvu s OrlandoFit i to u svoje ime i za svoju korist ili u svoje ime, a za korist Korisnika. Za slučaj da sklapa Ugovor o članstvu u svoje ime i za svoju korist, Ugovaratelj se smatra Korisnikom i može biti samo fizička osoba.

4. Ugovor o članstvu je ugovor sklopljen između OrlandoFit-a i Ugovaratelja, kojim se OrlandoFit obvezuje omogućiti korištenje fitness centra u vlasništvu ili zakupu OrlandoFit-a (dalje: fitness centri), opreme u fitness centrima, programa treninga u fitness centrima i druge svoje usluge Korisniku, sve u rokovima i pod uvjetima kako određeno ovim Općim uvjetima te drugim javno objavljenim pravilima OrlandoFit-a, a Ugovaratelj se obvezuje plaćati članarinu i upisninu OrlandoFit-u, u iznosu i rokovima kako određeno ovim Općim uvjetima, Cjenikom i drugim pravilima OrlandoFit-a.

Obveze Ugovaratelja na plaćanja članarine i upisnine ne ovise o korištenju usluga od strane Korisnika.

5. Cjenik je sastavni dio OrlandoFit Pravilnika.

6. Korisnik je fizička osoba koja ima vlastito i neposredno pravo koristiti usluge OrlandoFit-a sukladno odredbama ovih Općih uvjeta, drugih pravila OrlandoFit-a te Ugovora o članstvu sklopljenog u njegovu korist.

Svoje pravo korištenja usluga OrlandoFita-a Korisnik ne može ustupiti ili prenijeti drugoj osobi, osim uz pisano odobrenje OrlandoFit-a.

7. Korisnik može biti samo punoljetna i poslovno sposobna fizička osoba. Iznimno, Korisnik može biti i osoba koja je mlađa od 18 godina, uz pisano odobrenje zakonskog zastupnika (roditelja ili skrbnika). OrlandoFit ima pravo provjere istinitosti odobrenja zakonskog zastupnika.

8. Potpisom Ugovora o članstvu Ugovaratelj potvrđuje da je pročitao i razumio OrlandoFit Pravilnik, da prihvaća prava i obveze njima propisane te da je svjestan da nepoštivanje istih može dovesti do jednostranog otkaza Ugovora o članstvu od strane OrlandoFit-a, bez mogućnosti povrata uplaćene članarine.

9. Potpisom Ugovora o članstvu Ugovaratelj koji nije ujedno i Korisnik obvezuje se s odredbama Općih uvjeta upoznati Korisnika, prezentiranjem Ugovora, Općih uvjeta i na svaki drugi prikladan način.

Početkom korištenja usluga OrlandoFit-a Korisnik potvrđuje da je upoznat sa ovim Općim uvjetima, da ih je razumio, da prihvaća njime propisana prava i obveze te da je svjestan da nepoštivanje istih može dovesti do jednostranog otkaza Ugovora o članstvu od strane OrlandoFit-a, bez mogućnosti povrata uplaćene članarine.

10. Članska iskaznica glasi na ime Korisnika te je neprenosiva. Članska iskaznica se izdaje i predaje Korisniku nakon uplate upisnine i sklapanja Ugovora o članstvu pri prvom dolasku Korisnika u fitness centar OrlandoFit-a (prilikom sklapanja Ugovora, a najkasnije 3 dana prije prvog dana korištenja usluga OrlandoFit-a, potrebno je obavijestiti OrlandoFit u kojem fitness centru će Korisnik preuzeti svoju člansku iskaznicu).

Članska iskaznica se mora predočiti prilikom svake posjete fitness centru. Ukoliko Korisnik ne predoči valjanu člansku iskaznicu ne može koristiti usluge fitness centra.

U slučaju gubitka članske iskaznice plaća se naknada za izradu nove prema važećem Cjeniku.

SKLAPANJE UGOVORA

11. Ugovaratelj ispunjava tipski obrazac Ugovora o članstvu koji je pripremio OrlandoFit, te je Ugovor sklopljen kada ga potpišu Ugovaratelj i OrlandoFit.

Obrazac za potpisivanje Ugovora se Ugovaratelju dostavlja/predaje prema njegovom odabiru, u tiskanom obliku ili elektronskom obliku (u tom slučaju potrebno je napraviti elektronski potpis).

VRIJEME NA KOJE SE UGOVOR SKLAPA

12. Ugovor se može sklopiti na vrijeme od mjesec dana (Mjesečni ugovor), 12 mjeseci (Godišnji ugovor) ili 13 mjeseci (Produženi godišnji ugovor).

Godišnji ugovor sklapa se na period od 12 mjeseci tijekom kojih Ugovaratelj plaća članarinu. Tijekom tih 12 mjeseci Korisnik ostvaruje pravo upisati pauzu u najmanjem trajanju od 10 dana, a maksimalnom trajanju od 60 dana, u bilo kojim razmacima po svom izboru i bez dodatnih objašnjenja, te se za navedeni period Korisniku produžuje članarina (do maksimakno 60 dana).

U slučaju sklapanja Produženog godišnjeg ugovora, Ugovaratelj plaća članarinu tijekom perioda od 12 mjeseci, nakon kojeg Korisnik ostvaruje pravo na jedan mjesec korištenja usluga OrlandoFit-a bez ikakvih naknada i naplata.

PLAĆANJE UPISNINE I ČLANARINE

13. Upisnina je jednokratni iznos koji Ugovaratelj plaća prilikom sklapanja prvog Ugovora o članstvu. Visina upisnine je propisana Cjenikom koji je sastavni dio Ugovora o članstvu.

14. Članarina je naknada za korištenje usluge i opreme OrlandoFit-a, te predstavlja iznos koji Ugovaratelj plaća na način i u rokovima odabranim u Ugovoru o članstvu. Visina članarine je propisana Cjenikom koji je sastavni dio Ugovora o članstvu.

15. Način i rok plaćanja članarine ovise na koje vrijeme iz članka 12. se sklapa Ugovor:

– kod Mjesečnog ugovora članarina se plaća u cijelosti unaprijed za tekući mjesec

– kod Godišnjeg i Produženog godišnjeg ugovora Ugovaratelj
može odabrati jednokratno plaćanje (članarina se plaća unaprijed, obveza na plaćanje članarine dospijeva prilikom potpisivanja ugovora)

– kod Godišnjeg i Produženog godišnjeg ugovora OrlandoFit može Ugovaratelju odobriti obročno plaćanje do najviše 12 obroka (članarina se plaća unaprijed, datum dospijeće svakog obroka odredit će se prilikom odobrenja obročnog plaćanja, te će činiti sastavni dio Ugovora o članstvu)

16. Neovisno o tome je li sklopljen Mjesečni, Godišnji ili Produženi godišnji ugovor, članarina se može plaćati kreditnim ili debitnim karticama banke putem internet ili mobilnog bankarstva, trajnim nalogom (kojim OrlandoFit svaki mjesec, u datumu definiranom s Ugovarateljem, daje Banci nalog da ustegne ugovoreni iznos članarine s aktivnog računa Ugovaratelja i prebaci ga na račun OrlandoFit-a, te, u kojem slučaju je Ugovaratelj dužan dostaviti ispunjeni i potpisani, te od Banke ovjereni obrazac trajnog naloga), uplatom u novčanicama, te kreditnom ili debitnom karticom na recepciji fitness centra.

17. Ukoliko Ugovaratelj po dospijeću članarine ili pojedinog obroka članarine nije podmirio svoje dugovanje, na dužni iznos teku zatezne kamate.

18. Ukoliko Ugovaratelj po dospijeću članarine ili pojedinog obroka članarine nije podmiro svoje dugove, OrlandoFit će mu dostaviti transakcijski račun kao i opomenu te ukoliko Ugovaratelj niti u daljnjem roku od 7 dana od uredne dostave opomene ne podmiri tražbinu, OrladnoFit ima pravo otkazati Ugovaratelju Ugovor o članstvu, pri čemu Ugovaratelj gubi pravo na povrat do tad uplaćenih članarina.

Dospjele, a neisplaćene obroke članarine OrlandoFit naplatit će ovršnim ili drugim sudskim postupkom.

VRSTE ČLANSTVA

19. Članstva se razlikuju ovisno o aktivnostima, broju dolazaka i općenito usluga OrlandoFita na koje Korisnik ima pravo po Ugovoru članstva, te su ista detaljno uređena i navedena u Cjeniku.

OSTALE OBVEZE UGOVARATELJA I KORISNIKA

20. Korisnici su obvezni pridržavati se radnog vremena fitness centra te su dužni napustiti fitness centar u naznačeno vrijeme zatvaranja. OrlandoFit pridržava pravo izmjene radnog vremena centra. Obavijest o promjeni radnog vremena će unaprijed biti naznačena u prostorijama centra kao i objavljena na web stranici OrlandoFit-a.

21. Opremu za fitness valja koristiti sukladno uputama i namjeni konkretne opreme. OrlandoFit nije odgovoran za posljedice nepravilnog korištenja opreme.

22. Svaki oblik korištenja fitness centra provodi se na vlastiti rizik Korisnika, te OrlandoFit i njegovi zaposlenici ne mogu biti odgovorni za bilo kakvu štetu i/ili ozljedu koja nastane Korisniku.

Sve usluge OrlandoFit-a, uključujući i svu opremu u fitness centrima Korisnik koristi na vlastitu odgovornost. Korisnik je dužan voditi računa o tome da ne postoje prepreke za bavljenje odabranim programom i uslugama OrlandoFit-a, uključujući i odabranu opremu u fitness centru, kao i o tome da sudjelovanje u tjelesnoj aktivnosti, odnosno uključivanje u programe OrlandoFit-a predstavlja rizik od ozljede, srčanog udara, čak i smrti, kao i drugih sličnih opasnosti.

OrlandoFit i njegovi zaposlenici ne mogu odgovarati za bilo kakvu štetu i/ili slična potraživanja Korisnika, koja bi mu eventualno nastala zbog korištenja usluga, programa i opreme OrlandoFit-a.

23. Korisnici individualnih treninga su obavezni rezervirati termin treninga, direktnim dogovorom s instruktorom, na recepciji fitness centra ili online rezervacijom, te istim kanalima komunikacije na vrijeme otkazati dogovoreni termin najmanje 12 sati ranije, ukoliko nisu u mogućnosti doći na trening.

Korisnik je dužan poštivati početak i kraj treninga, tj dogovoreno vrijeme treninga jer u slučaju kašnjenja Korisnika gubi pravo rezervacije treninga.

24. Svi polaznici grupnih programa trebaju rezervirati odabrani termin treninga, a najmanje 4 sata ranije otkazati svoje mjesto u grupi. Rezervaciju mjesta u grupi moguće je napraviti putem web ili mobilne aplikacije, pozivom na info telefon fitness centra ili putem emaila. U slučaju većeg broja Korisnika, prednost vježbanja imaju Korisnici koji su napravili rezervaciju.

Korisnik je dužan poštivati početak i kraj treninga, tj dogovoreno vrijeme treninga jer u slučaju kašnjenja Korisnika gubi pravo rezervacije treninga.

25. Korisnik mora voditi računa o osobnoj higijeni (osobito o mirisnoj komponenti), kako bi atmosfera za vježbanje bila što ugodnija.

26. Korisnici su obavezni održavati prostorije urednima, pristojno se ponašati, te se izražavati na način koji ne uznemiruje druge članove. Isto tako se obvezuju koristiti ručnike tijekom treninga i nositi propisnu i čistu sportsku odjeću. Nije dopušteno ulaziti u prostorije za trening i opuštanje u obući koja se nosi van tih prostorija. Korisnik je obvezan obrisati i očistiti opremu i trenažere nakon korištenja.

27. Utezi, bućice, šipke i druga pokretna oprema se nakon korištenja mora vratiti na mjesto predviđeno za odlaganje istih.

28. Nije dozvoljeno zauzimanje više radnih mjesta odjednom, niti sjedenje i odmaranje na spravi, već se ista nakon odrađene serije treba prepustiti drugima.

29. Zabranjeno je unošenje sportskih torbi, vrećica ili slično, u prostor za vježbanje. Navedene predmete potrebno je ostaviti u garderobnim ormarićima.

Zabranjeno je unošenje hrane i korištenje staklenih posuda u prostoru za trening.

30. OrlandoFit nije odgovoran za osobne predmete ostavljene unutar prostorija fitness centra, te ne odgovara za gubitak ili krađu istih. Svi osobni predmeti moraju biti uklonjeni iz ormarića nakon završetka korištenja istih.

Korisnik se može obratiti osoblju OrlandoFit-a ukoliko ima vrijednije predmete koje bi htio dati na čuvanje tijekom boravka u prostorijama fitness centra.

31. Pušenje, konzumacija i prodaja alkohola, droga i ilegalnih preparata su strogo zabranjeni. OrlandoFit ima pravo otkazati Ugovor o članstvu Korisnicima koji se ne pridržavaju ove zabrane, te će takvi Korisnici biti odmah udaljeni iz centra.

32. Korisnici ne smiju ulaziti u prostorije za osoblje. Također je zabranjeno postavljati bilo kakve postere i/ili osobne informacije bez suglasnosti uprave OrlandoFita-a.

33. Korisniku (uključujući i Korisnike koji su vanjski osobni treneri i instruktori) je zabranjeno koristiti fitness centre, kao i opremu fitness centra u komercijalne svrhe, primjerice provoditi osobni fitness trening ili pružati druge usluge osobnih savjeta za treniranje drugih članova i slično bez prethodnog dogovora i
pisanog odobrenja Uprave OrlandoFit-a. Nije dozvoljena niti jedna osobna vrsta reklamiranja u prostorijama fitness centra, ukoliko ista nije definirana i odobrena od strane OrlandoFit-a.

Treneri koji vode osobne i/ili grupne treninge unutar prostorija OrlandoFit-a su isključivo zaposlenici i suradnici tvrtki OrlandoFit-a ili trgovačkih društava, udruga i klubova s kojima OrlandoFit ima definirane ugovorne odnose o pružanju takvih usluga.

34. Ako se utvrdi da je Korisnik tijekom svog boravka u fitness centru bio nasilan ili da je nekome prijetio bit će trenutno udaljen iz prostorija OrlandoFit-a.

35. Za slučaj neprimjerenog ponašanja, osoblje Orlandofita ovlašteno je opomenuti Korisnika, naložiti mu primjereno ponašanje i/ili ga udaljiti iz fitness centra. Takve naloge, opomene i radnje, Korisnik je dužan poštivati i sukladno njima uskladiti svoje ponašanje.

36. Ako Korisnik prekrši bilo koje od pravila iz članka 31-35, OrlandoFit može u bilo kojem trenutku otkazati Ugovor, bez omogućavanja otkaznog roka i bez obveze povrata članarina uplaćenih do trenutka otkaza.

OBVEZE ORLANDOFIT-a

37. OrlandoFit se obvezuje osigurati prostorije za vježbanje sukladno propisanim zakonskim uvjetima poslovanja fitness centra, te svu opremu i rekvizite za vježbanje, kao i dodatne prostorije potrebite za kvalitetno pružanje usluga.

38. OrlandoFit se obvezuje cjelokupnu opremu i rekvizite redovito održavati, servisirati i držati je u ispravnom i funkcionalnom stanju.

39. OrlandoFit se obvezuje redovito održavati urednost i čistoću svih korisnih površina i prostorija fitness centra.

OTKAZ UGOVORA

40. Ugovor o članstvu mogu otkazati Ugovaratelj, Korisnik i Orlandofit pod uvjetima iz OrlandoFit Pravilnika.

41. Godišnji ili Produženi godišnji Ugovor o članstvu Ugovaratelj i/ili Korisnik mogu otkazati najranije nakon isteka 8 (osam) mjeseci od sklapanja Ugovora.

Ugovaratelj i/ili Korisnik mogu otkazati Godišnji ili Produženi godišnji Ugovor o članstvu s obročnim plaćanjem isključivo na dan dospijeća obroka članarine (i to najranije na dan dospijeća osmog obroka članarine). U slučaju da je otkaz dan nakon dospijeća posljednjeg obroka, smatrati će se da se Ugovor otkazuje s danom dospijeća prvog narednog obroka članarine.

Otkaz se daje pisano, izjavom koja je vlastoručno potpisana te poslana preporučenom pošiljkom OrlandoFit-u ili osobnim dolaskom u bilo koji OrlandoFit centar uz predočenje osobne iskaznice, gdje je Ugovaratelju i Korisniku dostupan obrazac o otkazu Ugovora koji je potrebno ispuniti i vlastoručno potpisati.

42. Iznimno od odredbe u točki 41. Ugovaratelj i/ili Korisnik Godišnji ili Produženi godišnji Ugovor mogu otkazati i prije isteka roka iz prethodnog članka i bez otkaznog roka, pod sljedećim uvjetima:

– ako Korisnik (i/ili Ugovaratelj) dostavi pisanu liječničku dokumentaciju o trajnom invaliditetu ili trajnoj bolesti koja onemogućava Korisnika da nastavi koristiti usluge OrlandoFit-a

– ako Korisnik (i/ili Ugovaratelj) dostavi potvrdu o otkazu Ugovora o radu (koji je neprekinuto trajao najmanje godinu dana), tj dokaz o novonastaloj nezaposlenosti, uz potvrdu Zavoda za zapošljavanje da trenutno nema drugih primanja, čime su njegova materijalna primanja smanjena i onemogućuju mu izvršavanje ugovornih obveza

Ugovaratelj ima pravo povrata dijela jednokratno plaćene članarine samo u situacijama opisanim u ovom članku, i to ovisno o trenutku otkaza Ugovora, kako slijedi:

– 25 % uplaćenog iznosa po Godišnjem ili Produženom godišnjem Ugovoru, za slučaj otkaza u periodu od 9. do 10. mjeseca

– 10 % uplaćenog iznosa po Godišnjem ili Produženom godišnjem Ugovoru, za slučaj otkaza u periodu od 11. do 12. mjeseca

43. Osim u slučajevima iz čl. 42 Ugovaratelj nema pravo na povrat do tad plaćenih sredstava u slučaju otkaza Ugovora o članstvu.

44. Ugovaratelj koji je otkazao Ugovor o članstvu, može sklopiti novi Ugovor o članstvu s OrlandoFit-om nakon proteka roka od 5 mjeseci, osim ako je do otkaza došlo zbog situacija opisanih u čl. 42.

45. Mjesečni ugovor Ugovaratelj i/ili Korisnik ne mogu otkazati.

46. OrlandoFit može otkazati Mjesečni, Godišnji ili Produženi godišnji ugovor, u sljedećim slučajevima:

– ako Ugovaratelj ne ispuni svoje dospjele obveze niti nakon 7 dana od primitka opomene o neplaćanju i transakcijskog računa

– ako Korisnik prekrši bilo koje od pravila ponašanja iz članka 31-35

– ako Korisnik opetovano (više od 3 puta) krši druga pravila ponašanja iz ovih Općih uvjeta

47. OrlandoFit u slučajevima iz prethodnog članka može izvanredno otkazati Mjesečni, Godišnji ili Produženi godišnji ugovor, bez otkaznog roka. Takav otkaz ima trenutni učinak, te Ugovaratelj nema pravo na povrat do tada plaćenih dospjelih članarina.

ZAMRZAVANJE ČLANARINE

48. Korisnik koji je ugovorio Godišnji ili Produženi godišnji ugovor ima mogućnost dugotrajnog zamrzavanja članarine (u trajanju od najmanje 3 mjeseca, a najviše godinu dana) samo ako ispunjava sljedeće uvjete i kriterije:

– ako dostavi pisanu liječničku dokumentaciju o privremenoj nesposobnosti uzrokovanoj bolesti ili ozljedi koja je u kontradikciji s usmjerenim vježbanjem

– ako je Korisnik u trudnoći i ne preporuča mu se vježbanje, o čemu je također potrebno dostaviti pisanu liječničku dokumentaciju

49. Korisnik koji je ugovorio Godišnji ugovor ima specijalne pogodnosti upisa pauze od najmanje 10 dana a najviše 60 dana, bez posebnih objašnjenja, kako je to opisano u čl. 12.

50. Korisnik koji je ugovorio Mjesečni ugovor, ima mogućnost upisati pauzu u trajanju od najmanje 7 dana a najviše 30 dana. Pauzu je moguće upisati maksimalno 3 puta tijekom kalendarske godine.

51. Pauza i zamrzavanje produljuje vrijeme trajanja članarine sukladno broju dana provedenih na pauzi, tj zamrznutom broju dana, ali ne odgađa dinamiku naplate i dospijeće plaćanja redovitih ugovorenih obroka članarine.

PRESTANAK UGOVORA O ČLANSTVU

52. Ugovor o članstvu prestaje:

– istekom roka na koji je bio sklopljen

– uredno dostavljenom izjavom o otkazu iz čl. 41

– uredno dostavljenom izjavom o otkazu iz čl. 42 zajedno sa cjelokupnom potrebnom dokumentacijom na adresu OrlandoFit-a

– danom predaje izjave o otkazu pošti, u slučaju kada OrlandoFit otkazuje Ugovor o članstvu

53. Neovisno o načinu prestanka Ugovora, OrlandoFit ima pravo naplatiti sve obveze koje su dospjele do dana prestanka Ugovora.

ZAŠTITA I KORIŠTENJE OSOBNIH PODATAKA

54. Društvo H.O.L.S d.o.o. je voditelj obrade te je kao takav obveznik primjene UREDBE (EU) 2016/679 EUROPSKOG PARLAMENTA I VIJEĆA od 27. travnja 2016. o zaštiti pojedinaca u vezi s obradom osobnih podataka i o slobodnom kretanju takvih podataka te o stavljanju izvan snage Direktive 95/46/EZ (u daljnjem tekstu Opća uredba o zaštiti podataka).

55. Osobni podaci u smislu Opće uredbe o zaštiti podataka su svi podaci koji se odnose na pojedinca čiji je identitet utvrđen ili se može utvrditi.

U smislu Opće uredbe o zaštiti podataka ispitanik je svaki pojedinac (fizička osoba) od kojeg voditelj obrade prikuplja i obrađuje osobne podatke.

Svoju politiku zaštite osobnih podatka H.O.L.S d.o.o. temelji na načelima zakonitosti, poštenosti, transparentnosti, ograničavanja svrhe i smanjenja količine podataka, točnosti osobnih podataka, ograničenje pohrane, cjelovitosti i povjerljivosti, te pouzdanosti.

56. Osobni podaci obrađuju se na temelju privole ispitanika, legitimnih interesa Društva, izvršenja ugovora te drugog zakonskog razloga.

Ukoliko se osobni podaci obrađuju temeljem jasne i izričito dane privole ispitanika, jednom dana privola u svakom se trenutku može povući bez da to utječe na zakonitost obrade na temelju privole prije njezina povlačenja. Prednje podrazumijeva i pravo odjave od zaprimanja newsletter u bilo kojem trenutku.

Privolu za obradu osobnih podataka dijeteta mlađeg od 16. godina mora dati nositelj roditeljske skrbi za to dijete.

57. Osobni podaci obrađuju se u svrhu:
• evidencije radnika i obračuna plaće;
• odabira kandidata za posao temeljem određenog natječaja, prijave, molbe za posao;
• ispunjavanja ugovornih obveza Društva prema klijentima – poslovnim partnerima (primjerice knjigovodstveno evidentiranje kupaca i dobavljača, evidencije poslovnih događaja, te prikupljanja podataka radi obavljanja platnog prometa s partnerima – gotovinskog i bezgotovinskog i izvješćivanje partnera o stanju potraživanja i stanju obveza);
• ispunjavanja zakonskih obveza Društva;
• marketinške svrhe (primjerice dostavu obavijesti o komercijalnim akcijama, novim proizvodima i uslugama, newsletter-a, edukacijama itd.);
• poboljšanja usluge (primanje obavijesti vezanih za rad OrlandoFit-a, prigodnih čestitki za rođendane i ostale);

• pojedinačnog i sigurnog identificiranje korisnika usluge;
• zaštita osoba i imovine;
• ostvarivanje prava iz ugovora.

58. Ispitanik čiji se osobni podaci obrađuju ima pravo informiranja, pravo od voditelja obrade zatražiti pristup svim svojim osobnim podacima, ispravak ili brisanje osobnih podataka, ograničavanje obrade, pravo na prenosivost podata, pravo protivljenja profiliranju, kao i pravo prigovora na obradu te prigovora nadzornom tijelu. Svoja prava ispitanik može ostvariti podnošenjem zahtjeva službeniku za zaštitu osobnih podataka na e-mail: info@orlandofit.hr.

Društvo sve prikupljene podatke čuva na siguran način, uz primjenu odgovarajućih mjera zaštite. Osobni podaci koje Društvo prikuplja dostupni su samo radnicima Društva kojima su ti podaci nužni za obavljanje posla i izvršenje zakonskih obveza Društva.

Društvo prikuplja samo one osobne podatke koji su mu osobno dostavljeni od strane ispitanika i/ili one podatke koji su nužni za ispunjenje obveza.

Društvo može prikupljene osobne podatke otkriti drugoj fizičkoj ili pravnoj osobi, tijelu javne vlasti, agenciji ili drugom tijelu u kojem slučaju je Društvo dužno primjenjivati pravila o zaštiti podataka prema svrhama obrade te je dužno informirati ispitanika o primateljima ili kategorijama primatelja osobnih podataka kako bi se osigurala poštena i transparentna obrada.

Zaštita osobnih podataka je ugrožena ako je došlo do gubitka podataka, krađe podataka, ako su podaci došli na uvid i/ili korištenje nekome tko nema ovlasti ili prava na to i slični slučajevi povrede osobnih podataka.

Povreda osobnih podataka (incident) uključuje i svaku situaciju u kojoj nije došlo do neželjenog događaja, ali je postojala velika opasnost (vjerojatnost) da do njega dođe jer Društvo i//ili izvršitelji obrade i/ili primatelji obrade nisu poštivali pravila i procedure Opće uredbe o zaštiti podataka, Zakona, te pravila internih akata Društva kojima se uređuje zaštita osobnih podataka.

Službenik za zaštitu podataka evidentira dojave odnosno prigovore u Evidenciji povreda osobnih podataka (incidenata) koju vodi Društvo.

O zaprimanju dojave odnosno prigovora o povredi osobnih podataka Službenik za zaštitu podataka obavijestit će Upravu Društva.

U slučaju povrede osobnih podataka Društvo bez nepotrebnog odgađanja i ako je izvedivo, najkasnije 72 sata nakon saznanja o toj povredi, izvješćuje Agenciju za zaštitu osobnih podataka o povredi osobnih podataka, osim ako nije vjerojatno da će povreda osobnih podataka prouzročiti rizik za prava i slobode pojedinaca.

U slučaju povrede osobnih podataka Društvo bez nepotrebnog odgađanja obavješćuje ispitanika o povredi osobnih podataka.

59. Osobni podaci koji se prikupljaju voditelj obrade pohranjivat će za vrijeme potrebno za ispunjenje svrhe obrade te daljnjih 5 godina od prestanka svrhe nakon čega će isti biti pobrisani, ako ne postoji drukčija zakonska obveza za Društvo.

60. Ugovaratelj i Korisnik odgovaraju za ažurnost osobnih podataka, točnu adresu i osobne kontakte. Smatra se da su važeći oni podaci o kojima su Ugovaratelj i Korisnik zadnje obavijestili OrlandoFit. U slučaju promjene navedenih podataka Ugovaratelj i Korisnik će bez odgode obavijestiti OrlandoFit o novim podacima, pisanim putem.

DOSTAVA

61. Dostava otkaza, opomena te svih obavijesti od kojih za neku od stranka počinje teći rok za poduzimanje određene radnje, vršiti će se na adrese naznačene u Ugovoru o članstvu, a na neku drugu adresu samo ako su Ugovaratelj i Korisnik o istoj naknadno obavijestili OrlandoFit, sukladno odredbama članka 60.

Dostava se vrši preporučenom pošiljkom i smatra se uredno izvršenom danom predaje pismena prijemnom poštanskom uredu.

OSTALE ODREDBE

62. Odredbe ovog Pravilnika i svih njegovih sastavnih dijelova (Cjenik) primjenjuju se dana sklapanja Ugovora o članstvu. Sve eventualne naknadne promjene obvezuju/primjenjuju se od dana kada su Ugovaratelj i Korisnik obaviješteni o njima.

63. OrlandoFit zadržava pravo isticanja i nuđenja posebnih pogodnosti (dalje: akcije) za postojeće i/ili za buduće članove. Akcije obvezuju OrlandoFit od dana njihova isticanja, ako u samoj akciji nije drugačije navedeno.

Prihvatom akcije smatra se početak korištenja akcijskih usluga ili sklapanja odgovarajućeg ugovora, ako se akcija samo na taj način može koristiti, a što će biti navedeno u akciji. Za slučaj sklapanja Ugovora po akciji, na Ugovor se uz akcijske pogodbe primjenjuje i ovaj Pravilnik sa svim njegovim sastavnim dijelovima, s time da u slučaju neslaganja pojedinih odredbi, prednost imaju akcijske odredbe.

64. U slučaju spora glede prava i obveza ili cjenika koji su sastavni dio Ugovora o članstvu, nadležan je sud u Zagrebu.

ORLANDOFIT ORDINANCE – GENERAL TERMS AND CONDITIONS

The fitness center is a place where many persons gather in one place at the same time, where the rules of good conduct must be complied with in order to feel satisfied while doing exercises.

GENERAL PROVISIONS

1. These terms and conditions (hereinafter, OrlandoFit Ordinance) govern the relations between OrlandoFit, Contractor and User, the rules of using services of OrlandoFit and they constitute an integral part of each Membership Agreement.

2. OrlandoFit is the company H.O.L.S. d.o.o., Tax No. OIB: 23971298808, registered with the Commercial Court in Zagreb, for the activities of improving physical fitness, other sports activities etc. OrlandoFit has fitness centers in Zagreb, at the location Nova Ves 17 (Fitness Kaptol) and Radnička 52 (Green Gold Gym).

3. Contractor is a person that enters into a membership agreement with OrlandoFit in his own name and on his behalf or in its own name but on behalf of User. In case of concluding the membership agreement in his own name and on his behalf, Contractor is considered to be User and can be only a natural person.

4. Membership Agreement is the agreement concluded between OrlandoFit and Contractor, by which OrlandoFit undertakes to allow using the fitness center owned or leased by OrlandoFit (hereinafter: the fitness centers), equipment in fitness centers, training programs in fitness centers and its other service to User, all under the terms and conditions as specified in these General terms and conditions and other published Rules of OrlandoFit, while Contractor undertakes to pay a membership fee and registration fee to OrlandoFit, in amounts and under terms as specified by the General terms and conditions, Pricelist and other rules of OrlandoFit.

The Contractor’s obligations to pay the membership fee and registration fee are not dependent on the use of services by User.

5. The Pricelist is an integral part of OrlandoFit Ordinance.

6. User is a natural person who has a personal and direct right to use the services of OrlandoFit in accordance with the provisions of these General Terms and Conditions, other rules of OrlandoFit and Membership Agreement concluded in his/her favor.

User may not assign or transfer his/her right to use the service of OrlandoFit to some other person, except with the written consent by OrlandoFit.

7. User can only be an adult and legally capable natural person. Exceptionally, User can be a person who is younger than 18, with the written consent by the legal representative (a parent or a foster parent). OrlandoFit is entitled to verify the authenticity of the consent by the legal representative.

8. By signing the Membership Agreement, Contractor confirms that he has read and understood OrlandoFit Ordinance, accepts the rights and obligations stipulated by them and that he is aware that non-compliance with them could lead to unilateral termination of the Membership Agreement by OrlandoFit, without the possibility of refund of the membership fee.

9. By signing the Membership Agreement, Contractor, that is not User at the same time, shall be obligated to make User familiar with the provisions of the General Terms and Conditions by presenting the Agreement, General Terms and Conditions and in any other appropriate manner.

After starting to use the OrlandoFit services, User confirms that he/she is familiar with these Terms and Conditions, that he/she has understood them and that he/she accepts the rights and obligations prescribed by them, and that he/she is aware that non-compliance with them could lead to unilateral termination of the Membership Agreement by OrlandoFit, without possibility of refund of the membership fee paid.

10. The membership card is issued in the User’s name and is non-transferrable. The membership card is issued and handed to User upon the payment of the registration fee and conclusion of the Membership Agreement upon first arrival of User in the OrlandoFit fitness center (at the time of concluding the Agreement and no later than 3 days prior to the first day of using the OrlandoFit services, OrlandoFit needs to be notified in which fitness center User shall pick up his/her membership card).

The membership card must be presented at every visit to the fitness center. Should User fail to present the valid membership card, he/she may not use the fitness center services.

In case of loss of the membership card, the fee for making the membership card shall be charged according to the applicable Pricelist.

CONCLUSION OF THE AGREEMENT

11. Contractor fills out a standard form of the Membership Agreement prepared by OrlandoFit, and the Agreement is concluded when it is signed by the Contractor and OrlandoFit.

The form for signing of the Agreement shall be submitted/handed to Contractor at his/her own choice, in printed copy or electronic form (in this case it is necessary to make an electronic signature).

TERM OF THE AGREEMENT

12. The Agreement can be concluded for a period of one month (Monthly agreement), 12 months (Annual agreement) or 13 months (Extended annual agreement).

The annual agreement is concluded for a period of 12 months during which Contractor pays for the membership fee. During this period of 12 months, User shall be eligible to take a break for a minimum period of 10 days and a maximum duration of 60 days, in any intervals of his/her choice and without further explanations, and the membership fee shall be extended by the relevant period (up to 60 days).

In case of concluding the Extended annual agreement, Contractor shall pay for a membership fee during the period of 12 months, after which User shall be eligible to one month of using the services of OrlandoFit without any fees and charges.

PAYMENT OF REGISTRATION FEE AND MEMBERSHIP FEE

13. The registration fee is a one-off amount paid by Contractor upon conclusion of the first Membership Agreement. The sum of the registration fee is prescribed by the Pricelist which constitutes an integral part of the Membership Agreement.

14. The membership fee is a fee for using the service and equipment of OrlandoFit, and is the amount that Contractor pays in the manner and within the timeframe as selected in the Membership Agreement. The sum of the membership fee is prescribed by the Pricelist which constitutes an integral part of the Membership Agreement.

15. The method and deadline for payment of the membership fee depend on the term of the Agreement as specified in Article 12:

– in case of a Monthly agreement, the membership fee is to be paid in advance in full for the current month

– in case of Annual and Extended annual agreement, Contractor
may choose one-off payment (the membership fee is to be paid in advance, the obligation for payment of the membership fee falls due at the time of signing the Agreement)

– In case of the Annual and Extended annual agreement, OrlandoFit may consent to Contractor’s paying the membership fee in installments, namely in a desired number of installments from 1 to 12, except when the membership fee is paid in installments at the reception desk of the fitness center, then OrlandoFit consents to the payment only in 12 installments (the membership fee is paid in advance, the maturity date for installments will be determined when consenting to paying in installments, and will constitute an integral part of the Membership Agreement).

16. Regardless of whether a Monthly, Annual or Extended annual agreement is concluded, the membership fee can be paid by credit or debit bank cards via the Internet or mobile banking, standing order (according to which OrlandoFit gives the Bank an order every month to debit the contracted amount of the membership fee from the active account of the Contractor at a date as agreed with the Contractor, and transfer it to the account of OrlandoFit, and, in which case the Contractor shall deliver the completed and signed standing order form verfied by the Bank), by payment in banknotes, credit or debit card at the reception desk of the fitness center.

17. Provided that Contractor failed to settle his/her debt upon maturity of the membership fee or a single installment, the default interests shall be charged for the outstanding amount.

18. If Contractor has failed to settle his/her debts upon maturity of the membership fee or a single installment for the membership fee, OrlandoFit shall send him/her transaction invoice and a remainder, and if Contractor fails to settle the debt within this further period of 7 days from the date of receipt of the remainder, OrladnoFit shall be entitled to terminate the Contractors’s Membership Agreement and Contractor shall be deprived of his entitlement to refund of the membership fees paid until then.

Due installments of the membership fees, but not paid shall be collected by OrlandoFit in enforcement or some other legal proceedings.

TYPES OF MEMBERSHIP

19. Membership varies depending on the activities, the number of arrivals and services of OrlandoFit in general, which User is entitled to according to the Membership Agreement, and they are specified in details and listed in the Pricelist.

OTHER OBLIGATIONS OF CONTRACTOR AND USER

20. Users are required to adhere to the opening hours of the fitness center and should leave the fitness center in the indicated closing time. OrlandoFit reserves the right to change the opening hours of the center. Notice of change of opening hours shall be indicated in advance in the premises of the center and posted on the OrlandoFit’s website.

21. The fitness equipment should be used according to the instructions and purpose of specific equipment. OrlandoFit shall not be responsible for the consequences of improper use of the equipment

22. Any form of using the fitness center shall be at User’s own risk and OrlandoFit and its employees cannot be held responsible for any damage and /or injury caused to User.

All OrlandoFit’s services, including all the equipment in the fitness centers shall be used by User at his/her own risk. User must keep in mind that there are no obstacles to use the selected programs and services of OrlandoFit, including the selected equipment in the fitness center, and should also bear in mind that the participation in physical activity, or participation in the programs of OrlandoFit pose risk of injury, heart attacks, and even death, as well as other similar hazards.

OrlandoFit and its employees cannot be held responsible for any damage and/or similar claims by User potentially caused to him/her

as a result of using the services, programs and equipment of OrlandoFit.

23. The individual training users are required to reserve a training term, by direct arrangement with the instructor at the reception desk of the fitness center or by online reservation, and must by using the same communication channels timely cancel the agreed dates at least 12 hours in advance if they are unable to come to the training.

User is obligated to observe the time of the start and end of the training, i.e. the agreed time of the training because in case of delays he/she will be deprived of the right to reserve the training.

24. All participants of group programs should reserve the selected training term, and cancel their place in the group at least 4 hours in advance. The group place can be reserved via the web or mobile applications, by calling the info line of the fitness center or by email. In case of a large number of Users, the advantage of doing exercise will be given to Users who have reserved the training.

User is obligated to observe the time of the start and end of the training, i.e. the agreed time of the training because in case of delays he/she will be deprived of the right to reserve the training.

25. User has to take care of personal hygiene (especially the aromatic components), in order to create a pleasant atmosphere for doing exercises.

26. The Users are required to maintain the rooms tidy, must behave properly, and express themselves in a way that does not harass any other members. They are also obligated to use towels during training and to wear proper and clean sportswear. They are not allowed to enter the training and relaxation rooms in footware that is worn outside these rooms. User is required to wipe and clean the equipment and trainers after use.

27. Weights, dumbbells, bars and other mobile equipment after use must be returned to the place where they are stored.

28. It is not allowed to occupy several workout places at once, or even sitting and resting on the workout device, but it should be left to the others after the workout series is done.

29. Entering sport bags, bags or the like, to the workout place is forbidden. These items should be left in the lockers.

Entering food and the using glass containers in the area of training is forbidden.

30. OrlandoFit shall not be held responsible for personal items left in the room of the fitness center, and shall not be responsible for loss or theft thereof. All personal items must be removed from the lockers after they are not used any more.

User can address the staff of OrlandoFit if he/she has some more valuable items that he/she would like to put into custody during his/her stay in the fitness center.

31. Smoking, consumption and sale of alcohol, drugs and illegal products are strictly prohibited. OrlandoFit is entitled to cancel the Membership Agreement to Users that do not observe this prohibition and these Users shall be immediately removed from the center.

32. Users is not allowed to enter the staff rooms. It is also prohibited to put up any posters and/or personal information without the consent of the OrlandoFit’s Management.

33. User (including the Users who are external personal trainers and instructors) are forbidden to use the fitness center, as well as the equipment of the fitness center for commercial purposes, such as to conduct personal fitness training or provide other services, such as giving personal advice to other members for training etc. without prior agreement and
written consent by the OrlandoFit’s Management. Not a single type of personal advertising in the premises of the fitness center is allowed, if it has not been defined and approved by OrlandoFit.

Trainers that conduct personal and/or group training within the premises of OrlandoFit are solely employees and associates of the OrlandoFit firms or companies, associations and clubs with which OrlandoFit has defined contractual relations on the provision of such services.

34. If it is found that User was violent or that he/she threatened someone during his/her stay in the fitness center, he/she will be removed from the premises of OrlandoFit.

35. In case of misconduct, the OrlandoFit’s staff shall be authorized to warn the User about it, order him/her to act appropriately and/or remove him/her from the fitness center. User is obligated to observe such orders, warnings and actions and behave in compliance with them.

36. If User violate any of the rules set out in Article 31-35, OrlandoFit may at any time cancel the Agreement, without giving a notice and without obligation to refund the membership fee paid by the time of cancellation.

ORLANDOFIT’s OBLIGATIONS

37. OrlandoFit undertakes to provide rooms for doing exercises in accordance with the prescribed legal requirements applicable to the fitness center operations and to all workout equipment and props and additional rooms required for quality service provision.

38. OrlandoFit undertakes to regularly maintain, service and keep the entire equipment and props in good repair and condition.

39. OrlandoFit undertakes to regularly maintain the neatness and purity of useful areas and fitness center rooms.

TERMINATION OF THE AGREEMENT

40. The Membership Agreement can be cancelled by Contractor, User and Orlandofit under the terms of OrlandoFit Ordinance.

41. Contractor and/or User may not cancel the Annual Membership Agreement before the expiration of 8 months’ term.

The termination is given in writing, by a statement that is signed by hand and is sent by registered mail to OrlandoFit or personally by coming to any OrlandoFit center presenting the ID, where the Agreement termination form is available to Contractor and User which needs to be filled out and signed by hand.

The notice period shall start running from the date of receipt of the statement of cancellation by OrlandoFit (or cancellation form filled out).

42. By way of derogation from section 41, Contractor and/or User may cancel the Annual Agreement prior to the expiry of 8 months’ period from the date of concluding the Agreement without notice period on the following conditions:

– if User (and/or Contractor) submits a written medical certificate of permanent disability or permanent illness that prevents User from continuing to use the OrlandoFit’s services

– if User (and/or Contractor) submits a confirmation of termination of the Employment Contract (which uninterruptedly lasted for at least one year), that is, the evidence of the newly occurred unemployment, accompanied by duly certificate of the Institute for
employment suggesting that currently he/she has no other income, which is why his/her financial resources are reduced and prevent him/her from carrying out his/her contractual obligations

Contractor is entitled to refund of the membership fee paid only in the situations described in this Article, depending on the moment of termination of the Agreement, in the way as follows:

– 25% of the paid amount of the annual membership fee for cancellation in the period from nine to ten months

– 10% of the paid amount of the annual membership fee for cancellation in the period from eleven to twelve months

43. Except in cases referred to in Art. 42, Contractor shall not be entitled to the refund of the funds paid until then in the event of termination of the Membership Agreement.

44. The Contractor that has terminated the Membership Agreement can enter into a new Membership Agreement with OrlandoFit after the expiry of five months’ period, unless the termination was caused by the situations described in Art. 42.

45. Contractor and/or User cannot terminate the monthly agreement.

46. OrlandoFit can cancel the Monthly, Annual and Extended annual agreement in the following cases:

– if the contractor fails to fulfill its due obligations even after 7 days from the receipt of notice of default in payment and transaction invoice

– if User violates any of the rules of conduct referred to in Article 31-35

– if User repeatedly (more than 3 times) violates any other rules of conduct under these General Terms and Conditions

47. In the cases mentioned in previous article OrlandoFit may extraordinarily terminate the Monthly, Annual or Extended annual agreement, without notice period. Such termination shall have immediate effect, and Contractor shall not be entitled to refund of the membership fees paid until then.

FREEZING OF MEMBERSHIP

48. User who has contracted Annual or Extended annual agreement has the option of long-term freezing of the membership fee (a minimum of 3 months and a maximum of one year) only if he/she meets the following conditions and criteria:

– if he/she delivers a medical certificate on temporary disability caused by illness or injury that is in contradiction with targeted workout

– If User is pregnant and no workout is recommended, which should also be supported by written medical documents

49. User that has contracted the Annual agreement has special benefits to take a break of at least 10 days and maximum 60 days, without any special explanation, as described in Art. 12.

50. User who has contracted the Monthly agreement may take a break for at least 7 days and maximum 30 days. The break may be taken not more than three times during a calendar year.

51. Break and freezing extend the duration of the membership by the number of days on break, i.e. frozen number of days, but do not defer the schedule of collection and maturity of the payment of regular installments of the membership fee.

EXPIRY OF THE MEMBERSHIP AGREEMENT

52. The Membership Agreement shall cease to be valid:

– by expiry of the term of the Agreement

– expiry of the notice period in case of cancellation as referred to in Art. 41

– on the date of submission of the statement of cancellation as referred to in Article 42 together with the entire documents to the OrlandoFit’s address

– on the date of submission of the statement of cancellation at the post office, in case when OrlandoFit terminates the Membership Agreement

53. Regardless of method of terminating the Agreement, OrlandoFit shall be entitled to recover any liabilities that fell due up to the date of termination of the Agreement.

TERMINATION AND USE OF PERSONAL DATA

54. The company H.O.L.S d.o.o. is a data processing controller and as such is obligated to comply with the (EU) REGULATION 2016/679 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of 27th April 2016 on the protection of individuals with regard to the processing of personal data and free movement of such data and on the repeal of Directive 95/46/EC (hereinafter referred to as the General Data Protection Regulation).

55. Personal data in terms of the General Data Protection Regulation includes all the data relating to an individual whose identity has been determined or can be determined.

In terms of the General Data Protection Regulation, the data subject is each individual (natural person) whose personal data is collected and processed by the data processing controller.

H.O.L.S d.o.o. bases its personal data protection policy on the principles of legitimacy, honesty, transparency, limitation of purpose and data volume reduction, personal data accuracy, storage limitation, integrity, confidentiality and reliability.

56. Personal data is processed based on the consent granted by the data subject, legitimate interests of the Company, performance of the contract and another legal reason.

If the personal data is processed based on the clear and explicitly granted consent, the consent granted once, can be withdrawn at any time without affecting the legitimacy of the processing based on the consent granted prior to its withdrawal. The foregoing also includes the right to signoff of receiving the newsletter at any time.

The consent for the processing of personal data of a child under the age of 16 must be granted by a parent or a foster parent.

57. The personal data is processed for the purpose of:
• Employee records and payroll account;
• Selection of job applicants based on a specific job advertisement, application, job application;
• Fulfillment of contractual obligations of the Company towards clients – business partners (e.g. accounting records of customers and suppliers, records of business events, and data collection for payment transactions with partners – cash and non-cash and reporting of the partner on the status of accounts receivable and the accounts payable);
• Meeting the Company’s legal obligations;
• Marketing purposes (for example, delivery of the information on commercial actions, new products and services, newsletters, education, etc.);
• Service improvements (receiving announcements about OrlandoFit operations, birthday greetings and others);
• Market research and resolving complaints and disputes
• Individual and safe identification of the service user;
• Protection of persons and property;
• Exercising rights under the contract.

58. A data subject whose personal data is processed is entitled to be informed, to require the processing controller to gain an acess to his/her personal data, correction or deletion of personal data, restriction of processing, to transferability of the data. Further, a data subject is entitled to object to the profiling and is entitled to object to the processing and file an objection to the supervisory body. The data subject can exercise its rights by submitting the request to the data protection officer at the following e-mail: info@orlandofit.hr.

The Company keeps all collected data in a safely manner, applying appropriate protection measures. Personal information collected by the Company is only available to the Company employees who need such data to perform the business and fulfill the Company’s legal obligations.

The Company only collects the personal data that was personally submitted to it by the data subject and/or the data necessary for the fulfillment of the obligations.

The Company may disclose the collected personal data to some other natural or legal person, body of public authority, agency or other body, in which case the Company shall apply the data protection rules for processing purposes and shall inform the data subject about recipients or recipient categories of personal data in order to ensure fair and transparent processing.

Personal data protection is compromised if data has been lost, stolen, or if the data has been accessed and/or used by someone who has no authority or right to do so and in similar cases of personal data breaches.

The personal data breach (incident) also includes any situation where no undesired event occurred, but there was a great danger (likelihood) of occurring thereof, because the Company and/or the processors and/or the processing receipients failed to comply with the rules and procedures of the General Data Protection Regulation, the internal bylaws of the Company governing the personal data protection.

The Data Protection Officer records the notices or complaints in the Record of personal information breach (incidents) conducted by the Company.

The Data Protection Officer shall notify the Company’s Management about the receipt of the notices or complaints about the data breach.

In the case of a personal data breach, the controller shall without undue delay and, where feasible, not later than 72 hours after having become aware of it, notify the Personal Data Protection Agency about the personal data breach, unless the personal data breach is unlikely to result in a risk to the rights and freedoms of individuals.

In the event of a personal data breach, the Company informs the data subject about the personal data breach without undue delay.

59. The personal data collected by the data controller will be stored for as long as it is necessary for the purpose of processing and for a further 5 years’ time after the end of the purpose after which it will be deleted, unless there is a different legal obligation imposed on the Company.

60. Contractor and User are responsible for updating personal data, exact address and personal contacts. The data that Contractor and User last communicated to OrlandoFit are believed to be the valid data. In case of a change to such data, Contractor and User shall immediately inform OrlandoFit about new information, in writing.

DELIVERY

61. Delivery of cancellation, reminders and all notices of which the deadline for taking some action starts to run for some of the parties, shall be served at the address indicated in the Membership Agreement, or at some other address only if Contractor and User have subsequently notified OrlandoFit about it, according to Article 60. The delivery is made by registered mail and shall be deemed duly executed on the day of delivery of the document at the reception post office.

OTHER PROVISIONS

62. The provisions of this Ordinance and all of its components (Pricelist) shall apply as of the day of signing the Membership Agreement. Any potential subsequent changes are binding/ shall apply from the date when Contractor and User were informed about them.

63. OrlandoFit reserves the right to grant special benefits and discounts, as in special circumstances, such as opening new OrlandoFit’s branches.

64. In the event of any dispute concerning the rights and obligations or pricelist that constitute an integral part of the Membership Agreement, the Court in Zagreb shall have jurisdiction.
